Cuba and the Challenge of the Socialist State of Law

Havana, Mar 5 (Prensa Latina) The Cuban Constitution, recently ratified in the ballot box, defines the island as a socialist state of law, which translates into an important legislative challenge, said today the president of the National Union of Jurists, José Alexis Guinarte

In an interview with Prensa Latina in this capital, Guinarte said that the definition contained in Article 1 of the new constitution, to which Yes said 86.8 percent of Cubans who participated in the referendum on February 24, means that everything must be legislated.

The aim is to identify the necessary norms to guarantee the entry into force of the law of laws – a total reform of the one in force since 1976 – and for that a key revision of the text in its entirety is essential, he stressed.

According to Guinarte, those laws that are not appropriate in principle and articulated to the Constitution must be modified or updated in their content, in order to have a magna carta in tune with the current political, economic and social context.

We have already created a group of capacities to respond to this challenge, and we did it in advance because we were certain that at some point a new Constitution would come, explained the jurist.

In this regard, he added that work is being done on initiatives such as the Family Code, the procedural laws, the Electoral Law and the regulations of the National Assembly of People’s Power and the municipal assemblies.

The magna carta, backed by almost seven million Cubans, expands individual rights and guarantees, incorporates changes in the structure of the State, strengthens popular power from the base with greater municipal autonomy and recognizes various forms of property, including private 

We are going to have an arduous legislative process in Cuba in the coming months, said Guinarte.

The president of the National Union of Jurists thought that the people of the island should be motivated by the importance of updating the rules and adapting them to the reality of the country.
